Introduction

Rivulis PTE Ltd. and its subsidiaries and affiliates worldwide (“Rivulis”, “we”, “us”, “our”), respects the privacy and data protection rights of our job applicants.

This privacy notice (this “Notice” or “Policy”) describes the personal information we have about you as a job applicant and your rights concerning that information. It also explains the policies and procedures we use regarding your personal information during our selection and recruitment process. 

We are committed to complying with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), UK General Data Protection Regulation (UK GDPR), and the California Privacy Rights Act (CPRA).

This Notice may be amended from time to time. We will post any change to this Notice on this page. If the changes materially affect the personal information about you that we already process, we will also make efforts to proactively notify you by email of the changes to the Notice.

Key terms used in this Notice

  • Applicant is any job applicant for a position at Rivulis.
  • Personal information is any information relating to an applicant.
  • Processor is any organization, such as a service provider, that processes personal information on behalf of Rivulis.
  • Processing is anything done with personal information such as collecting, recording, storing, organizing, altering, using, disclosing, transmitting, or deleting it.

Purposes of Processing and Collecting your Personal Information

We collect and process personal information about job applicants like you for the purpose of conducting a proper recruitment process, assessing how suitable you are for the position, deciding whether to hire you and, where relevant, preparing to enter into an employment agreement with you. Processing such information serves our legitimate interests to ensure recruitment of the best possible applicants.

We may also use your information where necessary to comply with a legal obligation or for purposes related to legal claims.

We may also process your personal information to consider you for future openings at Rivulis and our corporate group affiliates, other than the specific position to which you initially applied.

Personal Information We Collect

Your personal information as a job applicant may include: your name, contact details, address, qualifications, skills, hobbies and leisure activities, employment history, experience and education history, information presented in your CV (Curriculum Vitae) or cover letter, your employment preferences, photos and links to webpages or websites you operate online, and may possibly include your physical checks (to the extent required for the relevant position).

We may also collect additional information that you choose to share with us.

We may collect the names and contact details of your application references, as well as information we receive through reference letters or in our discussions with those references. It is your responsibility to obtain consent from those you provide as references before you give us their contact information.

You are not under any legal obligation to provide us with your personal information. However, we may not be able to consider your application for the position without this information.

Methods and Sources for Collecting your Personal Information and legal basis

Rivulis may collect the information from several sources:

  • Directly from you (including through documents you provide and interviews).
  • Recruiters or placement agencies
  • References and past employers
  • Publicly accessible sources, such as LinkedIn and Facebook.

Data Retention and Future Use

We retain information about your candidacy for the initial period necessary for the recruitment process unless.

Personal information of unsuccessful applicants will be deleted within the period of the applicable local statute of limitation, which is in most jurisdictions 7 years after notifying candidates of the outcome of the recruitment exercise. We will retain the information of candidates we ultimately hire for as long as we employ them and for an additional period, thereafter, allowed under the applicable local statute of limitation.

Your Right to Access

You may request to review the information we have about you. Your right to review your information is also subject to the limitations specified in the applicable law.

Sharing Your Personal Information

Your information will be shared with our Human Resources and recruitment team, the manager overseeing the position to which you are applying, and at times, also other members of Rivulis to which the position may be related.

Because we operate our business as an affiliated group of companies, we sometimes may also share your information with companies in our corporate group, for the same purposes listed above.

We may share your information with the target entity of a merger, acquisition, or reorganization, and with legal counsels, and advisors, in case our corporation is going through such processes. We do so for the purpose of facilitating the structural change in the operation of our business.

In the extraordinary case of complaints and lawsuits relating to your candidacy, we might also share your information with our legal counsels and in court documents.

If a law or binding order required us to, we will disclose your personal information to the parties required under the law or the order.

In any case, we do not sell your personal information to third parties.

Information Security

We implement measures designed to secure your personal information and protect it from unauthorized disclosure, use or copying. We also require all those who have access to your personal information to implement such measures. However, although efforts are made to secure the applicant’s personal information, we cannot guarantee its absolute protection.

Changes to this Policy

Rivulis may change this policy. Such changes become effective when the updated policy is posted on our website. If the changes materially affect your privacy, Rivulis will notify you and seek your consent.

Notice to Applicants

Rivulis notifies applicants about the progress of their application according to applicable law. An applicant who was interviewed or completed assessment tests or questionnaires and was not hired by Rivulis will also be notified within the time frames set under applicable law. Our aim is to keep our applicants informed about their applications, in a reasonable manner.

Applicants from different jurisdictions

In some jurisdictions there are specific laws that governs personal information of applicants. Such specific local laws shall prevail this policy, so far as they are in favor of the Applicants. For convenience of our Applicants in the EU, UK and California, we added specific Annexes to this Notice.

Miscellaneous

In case of any contradiction between the main document of this Notice and any of its Annexes, then the terms and conditions that are more in favor of the Applicant will prevail.

In case of changes in applicable privacy laws, such changes will be regarded as automatically incorporated in this Policy, from the effective date thereof.

The information included in this Policy should not be regarded as legal advice or as an interpretation of any law. Rivulis reserves all rights and claims under any applicable law with respect to any dispute arising under this Policy.

 

If you become employed Rivulis will notify you of additional categories of Personal Information that it collects, receives, and maintains for business purposes.

International data transfers

To facilitate sharing your information within Rivulis Group, we may transfer your information to our subsidiaries around the globe. We do so under the terms of a data transfer agreement which contains standard data protection contract clauses with adequate safeguards determined by the EU and the UK Information Commissioner’s Office.

 

Data subject rights

If you are in the EU or the UK, you have the following rights under the GDPR:

Right to Access and receive a copy of your personal information that we process.

Right to Rectify inaccurate personal information we have concerning you and to have incomplete personal information completed.

Right to Data Portability, that is, to receive the applicant personal information that you provided to us, in a structured, commonly used, and machine-readable format. You have the right to transmit this data to another person or entity. Where technically feasible, you have the right to have your applicant personal information transmitted directly from us to the person or entity you designate.

Right to Object to our processing of your applicant personal information based on our legitimate interest. However, we may override the objection if we demonstrate compelling legitimate grounds, or if we need to process such applicant personal information for the establishment, exercise, or defense of legal claims.

Right to Restrict us from processing your applicant personal information (except for storing it): (a) if you contest the accuracy of the applicant personal information (in which case the restriction applies only for a period enabling us to determine the accuracy of the applicant personal information); (b) if the processing is unlawful and you prefer to restrict the processing of the applicant personal information rather than requiring the deletion of such data by us; (c) if we no longer need the applicant personal information for the purposes outlined in this Notice, but you require the applicant personal information to establish, exercise or defend legal claims; or (d) if you object to our processing based on our legitimate interest (in which case the restriction applies only for the period enabling us to determine whether our legitimate grounds for processing override yours).

Right to be Forgotten. Under certain circumstances, such as when you object to our processing of your applicant personal information based on our legitimate interest and there are no overriding legitimate grounds for the processing, you have the right to ask us to erase your applicant personal information. However, notwithstanding such a request, we may still process your personal information if it is necessary to comply with our legal obligations, or for the establishment, exercise, or defense of legal claims.

If you wish to exercise any of these rights, please contact us through the channels listed in this Notice.

When you contact us, we reserve the right to ask for reasonable evidence to verify your identity before we provide you with information. Where we are not able to provide you with information that you have asked for, we will explain the reason.

Subject to applicable law, you have the right to lodge a complaint with your local data protection authority. If you are in the UK, you can lodge a complaint to Information Commissioner’s Office (ICO) pursuant to the instructions provided here.

 

Annex C

Additional Notices for Job Applicants Residing in California

Rivulis Irrigation, Inc., Avid Water LLC, Jain America Holdings LLC., Jain Distribution Holdings Inc. and/or any affiliated entities, provide this Additional Notices for Job Applicants Residing in California (“Additional Notice”) to describe our privacy practices with respect to our collection of Personal Information as required under the California Consumer Privacy Act of 2018 and the California Privacy Rights Act (“CCPA”).

This Additional Notice applies only to job applicants and candidates for employment who reside in the State of California (“Consumers”) and from whom we collect “Personal Information” as described in the CCPA.

We provide you with this Additional Notice because under the CCPA, California residents who are job applicants qualify as Consumers. For purposes of this Additional Notice, when we refer to Consumers, we mean you only to the extent you are job applicant of the Firm who resides in California.

Information we collect about Consumers.

We may collect Personal Information from you in a variety of different situations and using a variety of different methods, including, but not limited to, on our website, your mobile device, through email, in physical locations, through written applications, through the mail, and/or over the telephone. Generally, we may collect, receive, maintain, and use the following categories of Personal Information, depending on the Business Purpose and to the extent permitted under applicable law:

How We Use Personal Information.

The personal information we collect, and our use of Personal Information may vary depending on the circumstances. This Additional Notice is intended to provide an overall description of our collection and use of Personal Information. Generally, we may use or disclose Personal Information we collect from you or about you for one or more of the following purposes:

  1. To fulfill or meet the purpose for which you provided the information. For example, if you share your name and contact information to apply for a job with the Firm, we will use that Personal Information in connection with your candidacy for employment.
  2. To comply with local, state, and federal law and regulations requiring employers to maintain certain records, as well as local, state, and federal law, regulations, ordinances, guidelines, and orders relating to COVID-19.
  3. To evaluate your job application and candidacy for employment.
  4. To obtain and verify background check and references.
  5. To communicate with you regarding your candidacy for employment.
